AMHP Refresher: Case Law Update

Brief summary:

The aim of this refresher day is to provide a review of the most significant decisions of the senior courts and upper tribunal relating to the role of the AMHP, focusing in particular on S.135 warrants, Nearest Relative matters in respect of Consulting and Displacement, along with related decisions dealing with CTO’s, Guardianship and DoLS.

 

Learning outcomes:

  • To be up to date as regards to case law developments relating to the role of the AMHP, particularly S.135 warrants and Nearest Relative
  • To review the ongoing emphasis highlighted by the case law of the need to demonstrate the application of Art’s 5, 6 and 8
  • To explore recent case law on delegation powers, notably linked to conveyance
  • To explore potential risks to P, the AMHP, the LA due to lack of bed availability – has there been any case law developments? Or might there be some pending?

 

Who should attend?

This refresher is aimed at AMHPs, as part of their annual CPD requirement.

The session does not include an assessment. On completion, participants will be provided with a certificate of attendance which will include the CPD hours achieved.

 

About the facilitator:

Doug Feery started out his professional career in child care / protection social work. After 11 years he re-trained and qualified as a Barrister in 2000. Since then he has worked predominantly in mental health and adult social care areas acting for those detained from low secure through to maximum security. Alongside this, Doug has progressed various civil, public law and human rights claims on behalf of individuals detained or in the community through Mental Health and Employment Tribunals, County and High Courts as well as several decisions in the Court of Appeal. Doug also works with the North West School of Psychiatry and delivers with them both the s.12 Approval and Re-Approval programmes. Doug has and continues to work with UCLan to support the delivery of AMHP and BIA courses (delivering the law modules for both programmes), and CPD refreshers.
